Openbusiness SA (hereinafter "SwissCenter") attaches great importance to the protection of your personal data. This privacy policy describes how we collect, use and protect your data when you use our services and our swisscenter.com website. It is drafted in accordance with the Swiss Federal Act on Data Protection (revised FADP, in force since 1 September 2023) and the European Union General Data Protection Regulation (GDPR – EU 2016/679) where applicable.

• Payment providers (in particular Wallee AG / PostFinance Checkout) for the secure processing of online payments
• Technical providers acting as processors (infrastructure, transactional e-mail, anti-spam, statistics) with whom we have signed confidentiality agreements in accordance with the law
• Administrative or judicial authorities where required by law

Transfers outside Switzerland / outside the EU

Your data is hosted and processed mainly in Switzerland. Where a transfer outside Switzerland or the European Economic Area is necessary, we ensure that it is governed by appropriate safeguards (adequacy decision, standard contractual clauses or any other instrument recognized by the FADP and the GDPR).

Retention period

Your data is kept only for as long as is strictly necessary for the purposes described above, and then archived or deleted in accordance with the legal retention periods (in particular 10 years for accounting and tax data under Swiss law).

Data security

We implement appropriate technical and organisational measures to protect your data against loss, alteration, disclosure or unauthorised access: TLS encryption of communications, access control, logging, regular backups, secure datacenter.

Your rights

In accordance with the FADP and the GDPR, you have the following rights regarding your personal data:

• Right of access and to obtain a copy of your data
• Right to rectification of inaccurate or incomplete data
• Right to erasure ("right to be forgotten"), within the limits provided by law
• Right to restriction of processing
• Right to data portability
• Right to object to processing, on grounds relating to your particular situation
• Right to withdraw your consent at any time when processing is based on consent
